2016年最低薪金法令已在2016年4月29日宪报上公布,并将在2016年7月1日起生效,取代原有的2012年最低薪金法令。
根据人力资源部2016年4月29日发布的文告,2016年最低薪金法令:
- 涵盖所有雇主,不论员工人数多少;
- 涵盖所有私人界员工,除了家庭女佣;
- 马来西亚半岛最低薪金为每月 RM1,000 或每小时81;沙巴、砂拉越及纳闽最低薪金为每月RM920 或每小时 RM4.42;
- 根据每周工作最多48小时,2016年最低薪金法令纳入了每日最低薪酬如下:

- e. 对于以件数、吨数、任务、路程或佣金方式计算薪酬的员工,其每月薪酬不得少过RM1,000 (马来西亚半岛)或 RM920(沙巴、砂拉越及纳闽);
- f. 自2016年7月1日开始,取消要求展延条款、薪金架构重组谈判条款及试用期员工最低薪酬删减条款。

The Minimum Wages Order 2016 (MWO 2016) which is gazetted on 29th April 2016 will take into effect from 1stJuly 2016, replacing the Minimum Wages Order 2012.
As highlighted in the Media Release by Ministry of Human Resources (MOHR) on 29th April 2016, MWO 2016:
- Cover all employers, regardless the number of employees;
- Cover all employees in private sector, except domestic servant;
- Minimum wage for Peninsular Malaysia is RM1,000 per month/ RM 4.81 per hour; and RM920 per month/ RM4.42 per hour for Sabah, Sarawak and Labuan;
- With maximum working hour of 48 hours per week, the daily minimum wages shall be as follows:

- e. For employees whose wages paid based on piece rate, tonnage, task, trip or commission, total monthly wages payable shall not be less than RM1,000 for Peninsular Malaysia or RM920 for Sabah, Sarawak and Labuan;
- f. With effective from 1stJuly 2016, clauses on Delay Application, Negotiation for Re-structure of Wages and Minimum Wages for Employees under Probation Period will be abolished
